Senate Order Entity Contracts
On 20 June 2001, the Senate made an Order requiring Ministers to table letters of advice that all non-corporate Commonwealth entities (NCCEs) (formally Financial Management and Accountability Act 1997 agencies) they administer had placed on the internet, lists of contracts valued at $100,000 or more (GST inclusive) which were current or entered into during the previous twelve months.
In 2002 and 2007, the Senate Standing Committee on Finance and Public Administration (the Committee) completed two inquiries in to the operation of the Senate Order. These inquiries resulted in change to the Senate Order requirements.
In 2014, as part of a further inquiry into the operation of the Senate order, the Committee recommended that NCCEs could satisfy the requirements of the Senate order as it relates to procurements contracts by reference to AusTender. This and other recommendations were reflected in the revised Senate Order. From 1 July 2015, reports will be generated by the Department of Finance and published on the AusTender Senate Order Report page.
The Senate Order requires the letter from the Minister to be tabled twice yearly, no later than 31 August, in the case of the financial year listing and no later than 28 February (29 February in a leap year), for the calendar year listing.
